What is an EB5 Investor Visa?

The U.S. Investor Immigration Program – known as “EB-5” – is one of the most effective ways for people from all over the world to obtain a green card and be able to live in the United States of America. After successfully completing the program, the investor and his/her family (spouse and unmarried children under the age of 21) receive conditional residency status in the United States, which can be converted into a permanent residence, pathway to citizenship.

How does it work?

Since its introduction in 1990 by U.S. immigration law, the EB-5 program offers a special immigration visa category for the high-net-worth international investor. To qualify for the program, the applicant must invest $900,000 in a business or project located in an area of the United States with a high unemployment rate. The applicant’s investment must create 10 full-time jobs within two years.

After approval of the initial application, which focuses primarily on establishing the legal source of the $900,000 investment (known as the I-526 petition), the applicant and his or her family are eligible for conditional resident status in the United States. Once the applicant establishes that the $900,000 investment was made in the selected project and the 10 full-time jobs were created within the required period (or will be created within a reasonable period of time), the visa status will be withdrawn and the applicant and his or her family will receive permanent resident status in the United States.
